PRIVACY STATEMENT

This privacy policy applies to Peacocke Dickens and Price and Peacockes Legal Service (collectively known as the "firm" or "Peacocke Dickens and Price"). This firm has chosen to be bound by the National Privacy Principles contained in the Privacy Act 1988 (Cth). However, as legal practitioners we are also bound by our duty of confidentiality to our clients which we take very seriously.

How we collect your personal information

In order to provide legal services to you we may need to collect personal information from you.  Such information may include the following:

  • Name, address, contact number, occupation, type of business, bank account number(s) and the names of relatives and/or related parties; and
  • Information about your matter on which you seek our legal advice.

 If you are unable to provide the information that we request we may not be able to provide you with our legal services. We primarily collect personal information from you in meetings, over the phone, e-mails or from forms filled out by you.  We may also collect personal information from third parties with your consent or off correspondence, business cards or invoices provided by you.

Obtaining access to your personal information

You may request access to your personal information at any time during office hours. If necessary we will require you to verify your identity and specify to what information you would like access.

 

How we use your personal information

Our firm will use your personal information for the primary purposes for which it is collected. This may include using your personal information to:

  • provide you with our legal services;
  • identify you from our other clients; and
  • comply with any legal obligations we may have.

 

How we disclose your personal information

Generally we will only disclose your personal information for a purpose that is related to the legal services that we are providing to you. This may involve disclosing personal information to:

  • other people or service entities which assist us in providing legal services to you, such as barristers, commercial agents, accountants, debt collectors and expert witnesses;
  • courts and tribunals; and
  • anyone else you authorise us to disclose it to.

These people are only authorised by us to disclose your personal information to third parties where there is a legal obligation to do so or where it is in accordance with the Privacy Act 1988 (Cth).

Keeping your personal information accurate, complete and up-to-date

Our firm will take reasonable steps to make sure that the personal information you provide to us is accurate, complete and up-to-date. We ask you to inform us of any changes to your personal information.

How we secure your personal information

Peacocke Dickens and Price takes all reasonable steps to ensure that your personal information is protected from misuse, loss, modification and disclosure and is only accessed by authorised personnel.

Our electronic databases require logins and passwords and most original hardcopy documents are locked in a fireproof safe. All of our staff enter into confidentiality agreements before commencing employment with our firm. We destroy your personal information once it is no longer needed or required to be kept by law.

Your right to lodge a complaint

If you are not satisfied with how we have handled your personal information you should lodge a complaint to us directly either in person or in writing. If you do not feel that this is an appropriate means of lodging your complaint you may contact the Federal Privacy Commissioner. Information on how to do this is available at the Commissioner's website at www.privacy.gov.au or by calling their information line on 1300 363 992.
